Alchemy of Tea – Terms & Conditions

By accessing, purchasing, or participating in any courses, programs, or digital content provided by Alchemy of Tea, you (“the User”) expressly agree to comply with these Terms & Conditions. These Terms govern your use of all courses, learning materials, and associated content made available by Alchemy of Tea, whether accessed online, through downloadable content, or via any other medium. If you do not agree with any part of these Terms, you must not access or use any Alchemy of Tea content.

1. Ownership of Content

All courses, modules, videos, audio recordings, documents, written materials, graphics, digital files, interactive content, and any associated intellectual property (collectively referred to as “Course Content”) are, and shall remain, the exclusive property of Alchemy of Tea / Jade Samurai Energy Trading. The Course Content is protected by copyright, trademark, and other intellectual property laws under local and international legislation. By accessing the Course Content, you are granted a limited, non-exclusive, non-transferable, and revocable license to view and use the Course Content solely for your personal, non-commercial educational purposes. This license does not confer any ownership rights, title, or interest in the Course Content to the User.

2. Prohibited Use and Restrictions

Users are strictly prohibited from copying, recording, reproducing, distributing, uploading, sharing, publishing, modifying, translating, creating derivative works from, or in any way using the Course Content outside the scope of the personal license granted herein. Users may not provide access to any third party, including but not limited to family members, colleagues, friends, or online communities. Any attempt to circumvent these restrictions, including the use of screen recording software, downloading tools, or other unauthorised methods of content capture, constitutes a material breach of these Terms. Users are expressly forbidden from using the Course Content for any commercial, promotional, or resale purposes.

All Course Content remains the sole property of Alchemy of Tea, and no part of it may be reused, repurposed, or disseminated in any format, physical or digital, without express written permission from Alchemy of Tea. Users are prohibited from sharing login credentials, access codes, or any other method of entry with any third party. Any such sharing will result in immediate termination of access, forfeiture of any payments made, and potential legal action.

3. Account Access and Responsibilities

Access to courses is granted through a user-specific account. Users are responsible for maintaining the confidentiality of their account credentials and for any activity conducted under their account. Alchemy of Tea reserves the right to suspend or terminate accounts at its sole discretion in the event of unauthorised access, sharing, misuse, or violation of any provision of these Terms. Users agree to notify Alchemy of Tea immediately if they suspect unauthorised use of their account.

4. Payments and Refunds

All course purchases must be made through the official Alchemy of Tea website or designated platforms. Prices are displayed at checkout and may be updated without prior notice. Refunds will only be issued in accordance with the separate Refund Policy of Alchemy of Tea. Users are responsible for ensuring that all purchase information is accurate. Alchemy of Tea reserves the right to refuse service or access in the case of payment disputes, fraudulent activity, or any breach of these Terms.

5. User Conduct

Users agree to engage with Alchemy of Tea content responsibly, ethically, and lawfully. Users shall not misrepresent themselves, the course content, or Alchemy of Tea, nor shall they engage in fraudulent, deceptive, or unlawful activity in connection with course access. Any conduct deemed by Alchemy of Tea to be harmful to its business, reputation, or intellectual property rights may result in immediate termination of access and potential legal action.

6. Liability and Indemnity

All courses are provided for educational purposes only. Alchemy of Tea makes no guarantees regarding specific outcomes or results from participation in the courses. To the fullest extent permitted by law, Alchemy of Tea shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the courses or any Course Content. Users agree to indemnify and hold harmless Alchemy of Tea, its officers, employees, and affiliates from any claims, damages, or liabilities arising from a violation of these Terms, misuse of content, or unauthorised sharing or distribution of Course Content.

7. Termination of Access

Alchemy of Tea reserves the right to terminate or suspend access to any course or content at any time if it determines, at its sole discretion, that a user has violated these Terms or engaged in conduct inconsistent with the intended use of the Course Content. Termination may be immediate, and any license granted herein will be revoked automatically upon termination.

8. Modifications to Terms

Alchemy of Tea may update, modify, or amend these Terms at any time without prior notice. Users are encouraged to review the Terms periodically. Continued use of any courses or Course Content after such modifications constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the national jurisdiction.

10. Agreement

By accessing, purchasing, or using any course, program, or content provided by Alchemy of Tea, the User acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions in full. Users also acknowledge that violations of these Terms may result in account termination, forfeiture of payments, and legal action, including claims for damages.
